I am a habitual pot smoker as I have chronic pain and it helps more than prescribed medication usually. However I have a court date scheduled for two week from now and I know I won’t come up clean if they test me upon arrival. Can I go to jail for this? and if so should I be set up with a lawyer ahead of time? It is my second DWI offense within the last year although with the first I only had a bac of .09 I’m not sure if that really makes a difference. I am trying really hard to get back on track and although it is against the law i can make a very good argument that pot helps me stay out of other sorts of trouble. thanks in advance.

Harris county has initiated or is soon initiating a new policy regarding simple possession less than 2oz for personal use. It will now or soon be a ticket for which u may take a class and get case dropped. It still however remains illegal, so hire a lawyer. There is new case law where you may be eligible to get out of jail without posting bail for misdemeanors depending on your inability to afford bail.
