Im on 5yr probation for domestic violence already with 3 yr joint suspension already but during i got arrestes but cited out for drug para. And poss. Of drug judge put me in a outpatient 18 month program which scheduled me to come back two months for proof of enrollment i stupidly been so busy forgot it was set for june 2 and today is june 22 what will happen
You have some problems and you will need an attorney to help you. I agree with Mr. Roberts. The failure to appear in court on June 2 will result in a warrant for your arrest for failing to appear in court. An attorney will be able to help you get the matter back on calendar and possibly be able to get the warrant “stayed” or recalled pending your appearance. When your attorney puts the matter back on calendar and you appear your attorney will explain the issue and/or problem to the court and request by asking the court that the warrant be recalled and that a new date be set to replace the court date you missed. The court can “stay” the warrant or recall the warrant. Your attorney will explain the difference. The DA can request the warrant not be recalled and only “stayed” in case you do not show again. You need to be there.
At the new court appearance the matter will proceed as it would have if you had initially appeared. The DA and the court will want to address the issues involving your probation violations. The DA may present an offer to your attorney or they may not. This depends on the county and the DA’s office. Once again your attorney will advise you.
