What is the law regarding a minor that has a driver’s permit but is caught driving without a guardian and he was speeding? He is 17 and I don’t know if he needs a lawyer or not. We live in Littleton but he got pulled in Aurora.
This is a traffic infraction and can result in 2-points on his license and a sentence involving community service work, a fine up to $50 (if it is a first offense), and possibly a traffic class. C.R.S. 42-4-116(3)
Generally, the prosecutor will review his driving record and make a plea bargain based on any prior violations as well as how fast he was speeding in this case. It is important to know how many points he has on his license and how many are offered in the plea. If he has 5 points within one year, or a total of 6 points before turning 18, his license will be suspended.
A minor driver under the age of 18 can have his driving privilege suspended if he has accumulated more than five points within any twelve consecutive months or more than six points for violations occurring prior to reaching the age of eighteen years. C.R.S. 42-2-127(1)(a)
