I Have an unpaid fine from a year ago for 88 dollars, but i have the money to pay it. Will i be arrested and placed in jail if i go pay it at the court?
Ryan: I practice in NC but I have some general ideas that may help…. Can you simply call the courthouse and ask if you can pay by mail? Then you don’t even need to go in person = no risk of arrest (I believe). Also, can you perhaps call and ask if there’s even an order/warrant for your arrest? Maybe you’re freaking out unnecessarily. Down here in NC a lot of offenses aren’t “serious enough” to issue a warrant. Again, no idea how it goes in DE, just general thoughts. Also, as I usually tell my clients down here, the court/justice system has big reasons to make it easy to pay off fines without fear of arrest like in this case maybe) since if they arrested every guy who comes to pay an old ticket they’d be making a huge DIS-incentive for people to come in and clear up their old stuff. Not only that, but arresting people costs $$$ (cops, jails, etc). Better to get the old fines and tickets paid without having to arrest people and spend $$$ to send the cops out and round them up.
