Officer wrote ticket for running red light turning right. It is legal to turn right on red in Ga. I was actually turning left. Do I have a chance to dispute the ticket or would it be considered an common error.
It sounds like you are shooting for a dismissal based on his confusing the direction of the turn. The crime is actually running a redlight, or failure to obey traffic control device (O.C.G.A. §40-6-20). The direction of the turn isn’t an essential element of the crime, and he can always correct this while testifying on the stand. You might be able to get him to admit that he doesn’t remember the facts of your stop, however, and if he doesn’t have first-hand personal knowledge of what he is testifying to then you might get the case thrown out. You should contact a local Georgia attorney to see if he can help you.
