I need to postpone my DWI jail and EHM sentence until I sell my home. Police forfeited my vehicle and I lost my job. I cannot work or afford to pay my bills! I need to postpone my sentence until I sell my home or give me 3-4 months to get affairs in order including the sale of my home. I cannot afford to pay my mortgage due to this issue. Can the judge grant this request?
You can certainly give it a shot. It would take a Motion requesting a sentence modification with a new start date. If you had an attorney that handled your case, I would contact them and see if they would be willing to help you file that Motion. But be aware that delaying a start date by 3-4 months is asking a lot. I wouldn’t hold your breath, but the worst a Judge would say is no. The Prosecutor would also need to be served with the Motion as well.
