So i had a small court hearing that i thought was in two days but it was actually five days ago and i just messed read the paper. Is it possible to reschedule another hearing?
Claudia: Was it YOUR suit against someone else, or the other way around? Here in NC where I practice, if it’s your suit against another person, if you don’t show up, the magistrate can dismiss the suit “without prejudice” (meaning you can do it over again if you re-file and all that). On the other hand, if it’s their suit against you, if they do show up and you do not, they can give evidence and proceed against you and get a judgment against you in your absence. Thus, what you can do from here really depends on which situation you were in (and again, once we know that, it’d be best to get the opinion of an LA lawyer!). Best, Terence….
