I was driving on I-35 to mt brother in law’s house with a friberglass bathtub in the bed and it came out and the car begind me hit it. I really think he was tailgaiting me. The wind was very strong that day and I was driviong normal just keeping up with traffic. The lady in the other car called the cops and they cited me for not securing the bathtub right. I told him it was on account of the wind but he gave me the ticket anyhow. I don’t think this is my fault.

Was there any damage to the vehicle that the bathtub hit? I understand that you don’t think its your fault and you certainly did not intend for this to happen, however, the bathtub did come out of the vehicle and onto the interstate creating a potentially dangerous situation. I believe that if you were to fight this ticket, a Polk County Judge would draw the conclusion that since you were carrying the tub in the bed of your truck. It is your responsibility to ensure that it stays there, regardless of weather issues.
