I was driving 5 mph higher than the speed limit (45 mph). The ticket contains fines and 4 other surcharges (fine: $35, total: $139). I was not sure if it is worthy to plead not guilty in my case (my purpose is simply to lower the payment). I am also not sure if there will be any points add to my licence (the officer told me it won’t, not sure if I can trust him). Can anyone help me?
plead not guilty and attend the hearing…sometimes the cop does not show up in which case it will be thrown out…if he or she does show up you just explain your position that you were only exceeding the speed limit by 5 mph according to the officer and only 4 mph according to your own speedometer and you simply did not notice that you were a few miles per hour above the speed limit but you certainly had no intention of driving recklessly. if you have no priors i doubt you will get points and the judge may even dismiss it… if you seek representation for the hearing most attorneys would charge at least $500 and maybe more if they need to travel far to the hearing location.
