Help!! i ended up having to drive my daughter’s babysitter home the other night (her ride fell through) and it was a little while after I had already taken an Ambien, something I get with a prescription to help me sleep through the night. On the way home I think I was swerving a bit because I got pulled over. While I didn’t admit that I had taken the ambien, the cop assumed I was under the influence of something because I obviously didn’t blow anything on the breathalyzer.
He ended up letting me off but it made me really nervous- how likely is it that I’ll be fined if this happens again?? like I said I have a prescription for this drug and I don’t abuse it at all. thanks
Yes, it falls under a DWI (DUI). I will be out of the country next week. I have a very lite schedule the remainder of the week. If you want to talk to me this week I will do a free consult. Just need to call the office, say I waived the consult and set up a time to talk to me.
You are lucky you were not charged with DWI because the definition of intoxication in Texas includes the loss of your normal mental or physical faculties due to the introduction of alcohol, a drug, combination of drugs, or any other substance. Therefore, regardless of prescribed or not prescribed you could still be arrested for the loss of your mental/physical faculties.
