Going 87 in a 60 mph on I-40. Is this something I can beat without a lawyer? I jjst want to not lose my license and maybe avoid insurance stuff…..
Dear Anon: 27 over is getting kinda fast. In cases like this, I always advise my clients to do a driving school. An 8-hr online school is the best. Get the certificate and bring that with you. I’d also say bring a copy of your driving record. It will help if it’s clean and has no alcohol or other tickets on it for at least 3 years back. I’d usually say try to get the DA to give you an “improper equipment” (IE) but at that speed, my feeling is they won’t want to. My next gut is to say that IF your record is clean for three years back, all you really need is a 69/60 to keep your insurance from getting jacked up. Again, at that speed I kinda doubt a DA will reduce it like that. Last resort is to ask the judge for a “PJC” (prayer for judgment continued). That will wipe out all license and insurance points for this offense. Thing is, it’s discretionary with the judge and you can only use ONE per household per three year period to kill insurance points. May wanna spend a little and have a lawyer help you on this one! If you do shop for a lawyer, try posting your case on the site here. It’s free and it’s an easy way to go about it.
