Cited for speeding 81mph on 55mph highway. I frankly don\’t remember going beyond 75mph. But, the officer gave me a citation for 81mph. I totally disagree with him. Somnone can help me please?
Depending upon what type of road you were on and what the officer marked on the citation, this could be a super speeder citation in Georgia. As others have said, if it can get reduced to a 14 mph over, then it becomes non-reporting. I will be glad to speak with you about your case. There may be some options with it. Also, due to the speed, it will be good to know whether you are under 21 or not. A speeding citation for going 26 mph over will suspend an under 21 driver’s license in Georgia.
First of all, White County is in northeast Georgia and fairly conservative. Contesting the speed of your vehicle is generally somewhat tough unless you have other evidence other than just your word that you were not going 81. Your options are to try to enter into a plea bargain and see if they will reduce the speed to 14 over so it will not get reported to the Department of Driver Services (DDS) and you will have to pay the fine, enter a plea to the plea reduction statute which would give you 0 points on your GA license and pay a reduced fine, or see if they have a pre-trial diversion program you could get into. Of course, you could enter a not guilty plea and have a trial, however unless you have some evidence that shows you were not exceeding the speed limit this is not recommended. My office is in downtown Decatur, GA and some distance from White County, however I have handled some traffic cases there in past years. In Georgia if you plea or are convicted to 14 mph over the speed limit or lower it is no points on your license (though your state may be different if you have an out of state license). In a case like this, however, you are likely facing the Georgia “super speeder” law and added fine by the State. You will want to ask the judge if you can take a speed reduction course in order to have the judge reduce the speed at which you are convicted in order to avoid the Super Speeder penalty and, hopefully also, to avoid points on your license.
