I was given a ticket by a NC state trooper for going 63 in a 45. It was a 2 lane highway and I was speeding up to pass a couple cars and apparently the trooper clocked me at 63.
This is my first ticket ever, is there any way to get a warning or reduce the charges?
Also, my license is CA and insurance is NC. What would the effect be on them for this ticket?
Hiya! 63/45 is not the end of the world by any means. Assuming you don’t want to go and have a trial (which is usually a losing proposition for speeding tickets IMHO) you have several options. 1) Try and get the DA to reduce it to “Improper Equipment” which is not even a moving violation. No points on your driving record and no insurance increase. If that fails for any reason, the DA will likely reduce it to 54/45 which, assuming you have no other tickets in the past 3 years, will not affect your insurance (though you will see a couple license points and who cares about that as long as your insurance doesn’t increase). Lastly, if you HAVE had a moving violation on your record in the past three years, ask the judge for a “prayer for judgment continued” or “PJC”. That will kill all points and insurance increase for this one. NOTE: PJC can only be used once per household (all drivers in your house) per three year period. Since your license is CA but insurance is NC all the rules apply as they are “insurance-driven” considerations. Not sure if you are military, but NC law says gotta get an NC license if you are here 60 days or more. Post your case on BernieSez (free!) and lawyers will contact you, BTW….
